Information and Documents for Central FSSAI License

The Food Safety and Standards Authority of India (FSSAI) has responded to a series of reports alleging that substandard food is being sold through food businesses classified on e-commerce service providers. The Food Safety and Standards Authority of India (FSSAI) has previously issued orders for e-commerce sites to exclude non-licensed or registered food vendors and retailers from their listings. Foodpanda, Swiggy, Zomato, and other prominent e-commerce brands have been asked to take immediate action.

The FSSAI guidelines, which went into effect in February 2018, made it mandatory for e-commerce platforms to show the listed Food Business's central FSSAI License or Registration number. A legal agreement between food business operators and e-commerce platforms is necessary to comply with the Food Safety and Standards Regulation.

To ensure compliance with the guidelines, e-commerce platforms submitted a report on actions taken, as well as the details of FSSAI licences of Food Businesses listed on their platforms, to the FSSAI. Internal audits of food suppliers, food service establishments, restaurants, and retailers listed by the e-commerce platforms in question have also begun.

The apex body has implemented a "e-commerce" form of business licence in the central category as part of its recent move toward advanced traceability and to ensure controlled buying and sale of food products online (over digital and electronic networks). This licence is now a prerequisite for conducting any food-related business via the internet. The FSSAI has identified two e-commerce business models for the purposes of this licence:

·         Inventory-Based Model – In this model, the inventory and food service are owned by the e-commerce FBO and sold directly to customers.

·         Model based on a marketplace – E-commerce FBO is an information technology platform that connects buyers and sellers, marketers and manufacturers.

The e-commerce FBO group may also include organisations that provide tertiary services like storage, distribution, or last-mile delivery.

The FSSAI has classified the obligations of e-commerce as a licencing obligation for them in terms of food protection for their customers. The following are some of the most important aspects of these responsibilities:

·         To show all of the food business entities listed on the platform's licences and registrations.

·         To ensure compliance with Food Safety and Standards Regulations, reach an agreement with the brand owner/seller. These FBOs would be responsible for their actions.

·         To ensure the presentation of a clear and legible picture of the product's "principal display screen."

·         Any food item that is delivered to a customer via e-commerce At the time of sale to the customer, FBO must have a shelf-life of at least 30% or 45 days before expiration. Caterers and restaurants who sell their goods online must ensure that only fresh food is delivered to the customer.

The FSSAI's compliance activities and a set of guidelines ensure that the new rules and regulations are implemented consistently and efficiently. The apex body's actions have been praised and endorsed by dedicated e-commerce platforms. Expert assistance is being sought by a number of aspiring and current e-commerce food businesses in order to ensure complete compliance with the FSSAI's Rules and Regulations.
